Relevant Provisions in Hong Kong Legislation.

(a) Defence Regulations. - 1940.

Reg. 55 (1)

Subject as hereinafter provided, the Governor, if it appears to him to be necessary or expedient so to do in the interests of public safety, defence or the efficient prosecution of the war, or for maintaining supplies and services essential to the life of the community, may by Order provide for the requisitioning of -

(a) any chattel in the Colony (including any

vessel or aircraft and anything; on board a vessel or aircraft), and

(b) any ship or aircraft registered in this

Colony or anything on board such ship or air- craft, wherever the ship or aircraft may be;

and may give such directions as appear to him to be be necessary or expedient in connexion with the requisition:

Provided that this regulation shall not authorize the requisitioning of anything on board a United Kingdom or Dominion ship or aircraft.

Reg. 55 (2).

Where the Governor requisitions any property (including a ship or aircraft) under this regulation, he may use or deal with, or authorize the use of or dealing with, the property for such purpose and in such manner as he thinks expedient in the interests of public safety, defence or the efficient prosecution of the war, or for maintaining supplies and services essential to the life of the community, and may hold, or sell or other- wise dispose of, the property as if he were the owner thereof.

Reg. 55 (4).

An order under this regulation may authorize any person, or any class of person, to perform such functions in connexion with the requisitioning, and may contain such directions, as appear to the Governor to be necessary or expedient.

Compensation (Defence) Regulations, 1940.

Reg. 6 (1).

The compensation payable under these regulations in respect of the requisition of any vessel, vehicle or aircraft shall be the aggregate of the following sums, that is to say
